General Terms and Conditions for Information Contracts

The mission of Digital Mind Agency Ltd. is to create a customized digital solution for every entrepreneur who wants to be present online and to build the foundation for their vision. In doing so, we accompany our customers as partners and only give them the strategies they really need. For this reason, Digital Mind Agency Ltd. offers its customers the opportunity to conclude a so-called information contract at various points. In doing so, Digital Mind Agency Ltd. undertakes to regularly provide the customer with further education and training material as well as general information. Firstly, it is Digital Mind Agency Ltd's mission to support young people in achieving their goals and to provide them with information and training material. Secondly, the subject matter of the respective information contract is determined on the one hand by the specific order and, in addition, by these General Terms and Conditions of Information (GTCI). Thirdly, the person ordering the information can terminate the contract at any time, informally and without giving reasons. Fourthly, this information service is free of charge.

§ 1 Subject matter of the contract, obligations of Digital Mind Agency Ltd.

(1) The object of the contract is for Digital Mind Agency Ltd. to provide the person requesting information with information via all conceivable contact channels (letter post, SMS, e-mail, social networks and comparable contact channels). In principle, the topics of this information are determined by the specific information contract (product and/or service description). In any case, however, this may include information from the following subject areas: online marketing, consulting, film/video, design, brand strategy, entrepreneurship, personal development, success, third-party products, marketing, sales, time management, digitalization, spiritual coaching start-ups and business start-ups, related and comparable topics, own seminars and webinars, third-party seminars and webinars, recommendations of suitable third-party products.

(2) With regard to paragraph 1, Digital Mind Agency Ltd. is also obliged to deliver the contractual information in social networks and comparable contact channels. For this purpose, Digital Mind Agency Ltd. is obliged, as far as technically possible, to upload the e-mail address to a custom audience on Facebook or to a "similar audience" on Google and, if this is possible, to deliver information there as well. This applies subject to the provision in paragraph 3.

(3) Digital Mind Agency Ltd. is also obliged to exclude the person requesting information, if they are already registered for a webinar, from advertisements for potential new webinar or training participants in facebook or Google within the scope of technical possibilities. To do this, Klick-Tipp must upload the email address to a custom audience on Facebook or to a "similar audience" on Google. In the case of advertisements for potential new training participants, the persons requesting information are excluded.

(4) There is no entitlement to all of these subject areas being covered.

(5) Furthermore, Digital Mind Agency Ltd. does not owe any advice or the examination of this information for correctness of content, but only the provision of the information.

§ 2 Conclusion of contract

(1) The information contract is concluded when the person requesting the information requests a service from Digistore24 GmbH and/or Digital Mind Agency Ltd. either digitally, in writing or in another clear (including implied) form, in whose product or service description reference is made to the conclusion of an information contract.

(2) These AIB shall also become part of the contract.

§ 3 Free of charge

The person requesting the information does not have to pay any money for the information.

§ 4 Termination of the information contract

(1) Both contracting parties may terminate the contract at any time without giving reasons and without observing a notice period.

(2) If the customer is also a customer of Digistore24 GmbH and receives access to Klick-Tipp via this contractual relationship, the existence of this information contract is not dependent on the existence of the contract with Digistore24 GmbH.

§ 5 Liability

(1) Digital Mind Agency Ltd. is only liable without limitation for intent and gross negligence.

(2) Digital Mind Agency Ltd. is only liable for simple negligence - except in the case of injury to life, body or health - if essential contractual obligations (cardinal obligations) are violated.

(3) Liability for indirect and unforeseeable damage, loss of production and use, loss of profit, loss of savings and financial loss due to third-party claims is excluded in the event of simple negligence - except in the event of injury to life, limb or health.

(4) Liability going beyond the scope of this contract is excluded - regardless of the legal nature of the asserted claim.
claim - is excluded. However, the above limitations or exclusions of liability shall not apply to strict liability prescribed by law (e.g. under the Product Liability Act) or liability under a no-fault guarantee.

(5) Insofar as liability is excluded or limited in accordance with paragraphs 2 and 3, this shall also apply to the personal liability of the employees, workers, representatives, organs and vicarious agents of Digital Mind Agency Ltd.

§ 6 Reservation of right of amendment

Digital Mind Agency Ltd. is entitled to amend these AIB unilaterally insofar as this is necessary to eliminate subsequent equivalence disturbances or to adapt to changed legal or technical framework conditions or to expand the range of information or information channels. The party ordering the information shall be informed of any change by sending a notification of the content of the changed regulations to the last known e-mail address. The amendment shall become an integral part of the contract if the party ordering the information does not object to its inclusion in the contractual relationship with Digital Mind Agency Ltd. in writing or text form within six weeks of receipt of the notification of amendment.
